Following the U.S. Supreme Court striking down Section 3 of the Defense of Marriage Act (DOMA) which prohibited federal recognition of same-sex marriage, in October of 2013, the New Jersey Superior Court held in the decision Garden State Equality v Dow that New Jersey’s restriction on same sex marriage was unconstitutional.
The Court found that because same-sex couples in New Jersey were at that time limited only to civil unions, which are not recognized as marriages under federal law, the State must permit civil marriage for same-sex couples as a constitutional right. Thereafter, same sex marriage has been legal in New Jersey as of October 2013.
