Establishing Paternity in New Jersey

For unmarried fathers, paternity is the foundation of every right that follows. New Jersey recognizes several ways to establish it: a voluntary Certificate of Parentage signed by both parents, or a court order following DNA testing. Simply listing the father’s name on the birth certificate isn’t sufficient to establish legal paternity for unmarried parents. A husband is presumed under NJ law to be the father of any child born during the marriage.

When DNA testing shows a man isn’t the biological father, the legal picture shifts. He generally has no obligation to pay child support and no inherent parenting time rights. NJ case law does recognize a “psychological parent” doctrine, however, for men who have functioned as a child’s parent for a significant period. Under that doctrine, a court may preserve the relationship even without a biological tie. Fathers who decline to participate in court-ordered DNA testing risk adverse outcomes in both custody and support proceedings.
